Privacy Policy
Protecting you and your family’s confidential information is our priority. This notice describes how information about you may be used and disclosed and how you can get access to this information. Please review it carefully. Your use of the services (“Services”) provided by the BeeSmart Rx mobile application, BeeSmart Rx website, and BeeSmart Rx (collectively, “we”, “us”, “BeeSmart Rx”, or “Site”), indicates your acceptance of all the provisions of this Privacy Policy. All terms herein that are capitalized but not otherwise defined have the meanings assigned to them in the Terms of Service. If you do not agree to these practices, please don’t use the Services.
What information does BeeSmart Rx collect from you?
To better provide the Services offered on our Site, BeeSmart Rx may collect PHI and Personally Identifiable Information (together with PHI, “PII”), such as your first and last name, E-mail address, location, and phone number, among other things, such as the information identified in the following.
- Registration and Online Inquiries
When you register for an Account or submit an inquiry via the Services or Site, we may ask you to provide your first and last names, as well as contact information such as your telephone number, physical address, and billing information, among other items as they are relevant to the Services. These other items may include without limitation your Prescription information, Social Security Number, date of birth, healthcare coverage information, and the name of your physician(s). We collect these items for the purpose of communicating with you and ensuring that we can efficiently provide the Services. Users will be asked to provide an email address to their account for added verification and to enable certain features, as applicable. We may also request other information pertinent to your health, including for example, allergies health conditions, surgical history, and medication history, in order to better provide the Services.
- Correspondence
If you email us or another party via the Services, we may gather your emails into a file to better assist with resolving the issue you have emailed us about. We may also make note of phone calls or other types of correspondence in the same file for the same purpose.
- Images Stored
If you submit your images to us, we may collect PII depicted in the imagery you submit.
- URL, IP addresses, Device Information, and Frequency of Use
We may collect and use this information to improve our services and optimize your personal experience.
- Anonymous Demographic Information
We may also collect anonymous demographic information, which is not unique to you or identifiable, such as your age, gender, location, and usage frequency.
By agreeing to BeeSmart Rx’s Terms, you agree to appoint BeeSmart Rx as your agent for certain purposes, including: (i) obtaining your medical information from your health care providers in order to provide the Services; and (ii) exercising your right to access your protected health information (“PHI”) pursuant to the Health Insurance Portability and Accountability Act (“HIPAA”). Please read the “Appointment as Agent” section of the Terms carefully in order to understand BeeSmart Rx’s ability to collect your PHI on your behalf. Please keep in mind that if you directly disclose PII through instances of providing feedback and ratings for BeeSmart Rx, this information may be collected and used by others.
How does BeeSmart Rx use your PII?
We do not collect any PII about you unless you voluntarily provide it to us. BeeSmart Rx collects and may use your PII to: (i) operate the Site; (ii) deliver the Services; (iii) bill for the Services; We will use such PII for, without limitation, communicating with you and other Users in relation to services and products you have requested from us, to improve the Site and Services, and to provide you with information regarding changes to our Site and Services. BeeSmart Rx may also use your PII to inform you of other products or services available from BeeSmart Rx and its affiliates.
More specifically, BeeSmart Rx may use your PII to assist you in managing your Prescriptions in the following ways. BeeSmart Rx may contact you by phone, email, or text to: (i) find out if you wish to request a Prescription refill; (ii) remind you to request a Prescription refill; (iii) confirm that a refill request has been submitted; (iv) ask if you wish to transfer a Prescription to a different Pharmacy; (v) notify you about the status of your Prescription; (vi) notify you we are contacting the Prescriber on file to clarify information regarding your Prescription;(vii) notify you of any other pertinent procedures or action on our part conducive to the management of your Prescriptions as stated by local pharmacy law; or (viii) provide other healthcare services or products.
BeeSmart Rx may also use your PII to deliver advertisements and marketing communications to you that we believe may be of interest. These advertisements and marketing communications will be delivered solely by BeeSmart Rx. Marketing communications that you receive from BeeSmart Rx may include: (i) advertisements for the BeeSmart Rx Services; (ii) advertisements for prescription drugs; and (iii) advertisements for other services.
We may also use your PII to help with public health and safety issues, for example; (i) disease prevention; (ii) product recalls; (iii) reporting adverse reactions to medications; (iv) reporting suspected abuse, neglect, or domestic violence; (v) preventing or reducing a serious threat to anyone’s health or safety; (vi) do research, (vii) comply with the law; (viii) respond to organ and tissue donation requests; (ix) work with a medical examiner or funeral director; (x) address certain regulatory and government requests; and (xi) respond to lawsuits and other actions. Who does BeeSmart Rx share your PII with and why?
BeeSmart Rx will not sell, rent, or lease your PII or other health or personal information other than as described herein unless we receive your express consent in writing to do so. You can change your mind at any time and must notify us about the change in writing. BeeSmart Rx may, from time to time, contact you on behalf of external business partners about an offering that may be of interest to you. In those cases, your unique PII is not transferred to the third party. BeeSmart Rx may share data with Pharmacies, Prescribers, and trusted affiliates to help provide the Services, perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries, and otherwise manage your Services. We may also use and share your PII to bill health plans or other entities for your Services. All such third parties are prohibited from using your PII except to provide these services to BeeSmart Rx, and they are required to maintain the confidentiality of your information.
You have the right and choice to tell BeeSmart RX what to share. You may tell us to: (i) share information with your family, close friends, or others involved in your care; (ii) share information in a disaster relief situation; and (iii) include your information in a hospital directory. If you are incapacitated and, as such, are not able to communicate we may go ahead and share your information if we believe it is in your best interest. We may also share your information when needed to lessen a serious and imminent threat to health or safety. In these cases we never share your information unless you give us written permission: (i) marketing purposes; (ii) sale of your information; and (iii) most sharing of psychotherapy notes. We may contact you for fundraising efforts, but you can tell us not to contact you again.
BeeSmart Rx may disclose your PII, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (i) conform to the edicts of the law or comply with legal process served on BeeSmart Rx; (ii) protect and defend the rights or property of BeeSmart Rx; and (iii) act under exigent circumstances to protect the personal safety of Users of BeeSmart Rx, or the public.
If another entity acquires BeeSmart Rx or all (or substantially all) of its assets or if any bankruptcy or reorganization proceeding is brought by or against BeeSmart Rx, your PII and anonymous information will be transferred to and used by this acquiring entity, though we will take reasonable steps to ensure that your preferences are followed.
What are your rights with respect to your health information?
- You may request that BeeSmart RX refrains from using or sharing certain health information for treatment, payment, or operations. Though BeeSmart RX will do its best to comply with your request, BeeSmart RX may deny your request if such a restriction would affect your care.
- Unless the law prevents it, we will comply if you may ask us not to share information for your out-of-pocket, in full payment for services or other health care items with your health insurer, if for the purpose of payment or BeeSmart RX’s operations with your health insurer.
- Once every 12 months, upon request, we will provide you with an accounting of the times we have shared your health information over the previous six years, including the parties we have shared it with and the reason why, with the exception of the instances of disclosure related to treatment, payment, and health care operations, as well as certain other disclosures, for example, those you asked for. We may charge you a reasonable, cost-based fee for additional requests of this information within a 12 month period.
- Upon request we will promptly provide you with a paper copy of this policy even if you have already agreed to receive the policy electronically.
- You can ask to view or receive a paper or electronic copy of your medical record or other PII we have about you. Upon request we will also provide a summary of your health information, usually within 30 days of your request. We may charge a reasonable, cost-based fee.
- You may request that we correct information about you that you believe is inaccurate or incomplete. If we refuse your request, we will tell you why in writing within 60 days.
- You may request confidential communications by asking us to contact you in a specific way (for example, home or office phone) or to send mail to a different address. We will happily accommodate all reasonable requests.
- You may allow someone else to act on your behalf. For example, if you have given someone medical power of attorney or if someone is your legal guardian, that person may can exercise your rights and make choices on your behalf. We will verify this person’s authority prior to taking action.
- If you feel your rights are being violated, you may complain to us or you may file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights by sending a letter to 200 Independence Avenue, S.W., Washington, D.C. 20201, calling 1-877-696-6775, or visiting www.hhs.gov/ocr/privacy/hipaa/complaints/. BeeSmart RX will not retaliate in any way for filing a complaint.
Is my information secure?
We are required by law to maintain the privacy and security of your PII. We must adhere to the obligations set forth herein, and we will provide you with a copy of this policy. We will promptly alert you in the event of a security breach that may have compromised the privacy or security of your information. We take commercially reasonable steps designed to protect data collected through the Services and Site, as well as your PII, using the SSL Protocol. We strive to take appropriate security measures to protect against unauthorized access to or alteration of your PII. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your PII, you acknowledge that: (i) there are security and privacy limitations inherent to the Internet which are beyond our control; and (ii) security, integrity, and privacy of all information and data exchanged between you and us through this Site cannot be guaranteed.
What are cookies?
The Site may use “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you.
One of the primary purposes of cookies is to save you time by enabling your device to remember that you have previously visited a specific website or mobile application and to remember the setting you chose, if any, during your previous visit. For example, if you personalize BeeSmart Rx pages, or register for the Site or Services, a cookie helps BeeSmart Rx to recall your specific information on subsequent visits. When you return to the Site, the information you previously provided can be retrieved, so you can easily use the BeeSmart Rx features that you customized.
You can accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the BeeSmart Rx services or websites you visit.
Is information you share with third party websites secure?
Our Site may link to or contain links to other Users’ websites and other third-party websites that we do not control or maintain, such as in connection with purchasing Prescriptions and other products referenced on our Site and banner advertisements. This Privacy Policy only addresses the use and disclosure of PII collected from you by BeeSmart Rx. We are not responsible for the privacy practices employed by any third-party website. We encourage you to note when you leave our Site and to read the privacy statements of all third-party websites before submitting any PII. Such third parties may be able to collect information about you, including information about your activity on the Site and Services, and we may collect information about you from the third parties, as well. WHEN YOU CONNECT YOUR BEESMART RX ACCOUNT TO YOUR THIRD-PARTY ACCOUNT, YOU CONSENT TO THE CONTINUOUS RELEASE OF INFORMATION ABOUT YOURSELF TO OTHERS (IN ACCORDANCE WITH YOUR PRIVACY SETTINGS ON THOSE THIRD-PARTY WEBSITES). IF YOU DO NOT WANT INFORMATION ABOUT YOURSELF, INCLUDING PERSONALLY IDENTIFYING INFORMATION, TO BE SHARED IN THIS MANNER, DO NOT USE THIS FEATURE.
What about children’s privacy?
Though the PII of minors under 13 years of age may be provided to BeeSmart RX by an authorized parent or guardian, neither the Services nor the Site is designed for or intentionally targeted at children under 13 years of age. It is not our policy to intentionally collect or maintain information about anyone under the age of 13. No one under the age of 13 should submit any PII to BeeSmart Rx. Those under the age of 18 may request deletion of any PII they submitted to BeeSmart Rx by sending an email to BeeSmart Rx at help@beesmartrx.com. Note that although every reasonable effort will be made to delete your PII, deletion does not ensure comprehensive removal of your data from all the systems.
How will BeeSmart Rx communicate news about updates and changes?
From time to time, BeeSmart Rx may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, or other general communication.
BeeSmart Rx periodically reviews its policies and reserves the right to amend them from time to time. If we amend this Privacy Policy, we will continue our commitment to keep your PII secure. We will notify you of any changes before they take effect by posting these changes on the Site. Your continued use of the Services after such modifications will constitute your: (i) acknowledgment of the modified Privacy Policy; and (ii) agreement to abide and be bound by the Privacy Policy.
